1. Scope of Privacy Policy

Iddiction, Inc. ("Iddiction") develops and publishes mobile applications ("Iddiction Apps"), such as App-o-Day, that promote mobile applications offered by third-party developers ("Developers"). This Privacy Policy (the "Privacy Policy") describes generally how we use and share information that we receive from: (a) Developers whose mobile apps are promoted by Iddiction; (b) individuals that use Iddiction Apps, including App-o-Day; and (c) visitors to websites operated by Iddiction ("Iddiction Websites"), including

2. Third-Party Websites and Mobile Apps

Iddiction Apps and Iddiction Websites may contain links that direct you to websites and apps that are developed and administered by individuals or companies that are not affiliates of Iddiction. Iddiction Apps may also contain links to mobile "apps stores," such as Apple's App Store, where you can download mobile apps distributed by third-party Developers. This Privacy Policy does not govern those third-party websites, mobile apps, or app stores. We suggest that you review the privacy policies governing those products and services when you link to them, as they may be materially different from this Privacy Policy.

Iddiction is not responsible for the practices individuals and companies that operate third-party websites, mobile apps, or app stores. Any link to those third-party products and services on an Iddiction App or Iddiction Website does not constitute our sponsorship of, or affiliation with, these individuals or companies.

3. Consent

By submitting information through Iddiction Websites or Iddiction Apps, you agree to the terms of this Privacy Policy and you expressly consent to the collection, use and disclosure of your information, including personal information, in accordance with this Privacy Policy.

4. Our Collection of Information

Iddiction collects the following categories of information from Developers, Mobile App Users, and Website Visitors:

  1. Information We Collect from You Directly
    If you provide us feedback or contact us via e-mail, we will collect your name and e-mail address, as well as any other content included in the e-mail, in order to send you a reply. When you participate in one of our surveys, we may collect additional profile information.
  2. Registration Information
    We may allow you to register with us using your email address or through a social networking site such as Facebook. Depending on how you choose to register, we may collect and store your email address and/or Facebook access token. We may also link your email address or Facebook access token to a unique identifier that we associate with your mobile device. When you register with us and sign in to our services, you are not anonymous to us.
  3. Device-Specific Information
    When you use of our Mobile Apps, we may collect the following information about your device:
    • an unique identification number that we assign to your device or mobile app;
    • platform type and version (i.e., iOS version 4.0);
    • hardware and processor type;
    • screen resolution;
    • version of Iddiction mobile app;
    • human readable hardware name;
    • session ID (a randomly generated ID created for each App session);
    • session length;
    • time stamp;
    • MAC address;
    • country; and
    • IP address
  4. Information Obtained from Linked Social Networking Sites
    When you register an Iddiction account using a social network such as Facebook or Twitter, you allow us to access certain information from your profile for that site. The information that you allow us to access may vary by social network and may be affected by the privacy settings that you and your friends have enabled. For example, depending on the social network and your settings, we may be able to access some or all of the following information:
    • your user name;
    • your Facebook or Twitter User ID number;
    • your profile picture URL;
    • your list of friends;
    • your gender;
    • your birthday or age;
    • your physical location and the location of your device;
    • your occupation and education;
    • your interests and group affiliations;
    • your posts;
    • email addresses and other contact information that is associated with your profile;
    • your session key; and
    • timestamps related to your usage of the site.
    Iddiction may store and combine information that we access about you through linked social networks with the unique identifier that we associate with your mobile device, as well as other information that we collect about you or your use of our products and services.
  5. App Usage Information
    We may collect information about your use of our Iddiction Apps, including the date and number of times that you launched a particular Iddiction App, the pages that you viewed, and any third-party apps that you selected for installation. We also collect information about the session ID, user ID (if logged in to Iddiction), total play time (across all Iddication App sessions), and session length (time using a specific Iddication App session).
    We may also collect information about your usage of third-party Apps that we promote in our Mobile Apps. For example, we may collect data that confirms whether you downloaded and installed apps that you discovered through the use of our Mobile Apps.
  6. Developer Information
    We collect billing and other contact information from our Developers, including names or company names, email address, app names, app platform(s), billing information (e.g., PayPal email address or billing address for invoices), and other information as required by our Developer Agreement.
  7. Third Party Tools
    Iddication Apps and Iddication Websites may also contain third-party tracking tools from our service providers, an example of which includes Google Analytics. Such third parties may use cookies, APIs, and SDKs in our services to enable them to collect and analyze User information on our behalf. While a third party may have access to your personal information in connection with the performance of services for Iddiction, it may not use such information for any purpose other than providing its services.
  8. Anonymous Information
    We may create anonymous information records from personal information by excluding information (such as your name) that make the data personally identifiable to you. Iddiction reserves the right to use anonymous information for any purpose and disclose anonymous information to third parties in its sole discretion.

5. How We Use Your Information

Iddiction may use the information that we collect in the following ways:

  1. To Contact You
    We may periodically send promotional materials or notifications related to Iddiction Apps or the third-party apps that we promote to the email address that you provide to us when registering. If you want to stop receiving promotional materials from Iddiction, you can email us at
  2. To Deliver Relevant Content and Make Recommendations to You
    We use device-specific information to select appropriate art for the screen resolution, to identify your account to simplify sign-on, and to determine the hardware requirements of our user base.
    In addition, to make your experience more interesting or relevant, we may combine and use any of the information that we collect from or about you, including your use of Iddiction Apps and the third-party apps that we promote, and information that we can access through social networks such as Facebook, to assist us in recommending particular apps or content to you.
  3. Enhance Our Products and Services
    We may use the information that we collect about you, including anonymous information to analyze request and usage patterns so that we may enhance the content of Iddiction Websites, Apps, and other products and services.
  4. For Billing Purposes
    We use billing and contact information from our Developers in order to facilitate payment for our services.

6. Information Sharing and Disclosure

Iddiction does not rent, sell, or share personal information about you with other people or companies which are not affiliates of Iddiction, except when we have your permission, as described above, or under the following circumstances:

  1. Affiliates
    We may share some or all of your personal information with our current and future parent company, any subsidiaries, or other companies under a common control, in which case we will require our affiliates to honor this Privacy Policy.
  2. Developers
    We share app-specific information in aggregated form with Developers. Such aggregated information may include, for example, how many unique individuals are logged in to an Iddiction App on a given day or how many Iddiction App sessions were used.
  3. Service Providers
    We provide your information to third-party vendors, including third party publishers and other service providers, who work on behalf of Iddiction and need the information to do work for Iddiction. These third party vendors are required not to use your personal information other than to provide the services requested by Iddiction.
    When you use or connect to an Iddiction website or download an Iddiction mobile app by or through a third party platform, such as Facebook or other social networking site, you allow us to access and/or collect certain information from your third party platform profile/account (such as your Facebook account) or via any cookies placed on your device by such third party platform as permitted by the terms of the agreement and your privacy settings with the third party platform. We will share such information with the third party platform for their use as permitted by the terms of the agreement and your privacy setting with the third party platform.
    We will share some of the information we collect from you upon install of the mobile app with vendors and other service providers who are engaged by or working with us in connection with the operation of the services we provide to you and/or for analytics purposes which may require the reproduction and display of such information in an aggregated and anonymized manner such that will not in any way identify you.
  4. To Protect the Rights of Iddiction and Our Users
    Regardless of any choices you make regarding your personal information (as described below), Iddiction may disclose personal information (a) to respond to subpoenas, warrants, court orders, lawful requests or legal process, (b) to establish or exercise our legal rights or defend against legal claims or protect our customers, (c) in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, or as otherwise required by law, or (d) to investigate any violation of this Privacy Policy or our Terms of Use.
  5. Acquirer
    We transfer information about you if Iddiction is acquired by or merged with another company. That company will possess the personal information collected by us and will assume the rights and obligations regarding your personal information as described in this Privacy Policy.
  6. Anonymous Information
    As described above, we may share anonymous information about you (and/or your Users if applicable) with any third parties, including our advertisers, publishers, business partners, and sponsors.

7. Your Choices

  1. Opting Out of Marketing
    We will periodically send you free newsletters and e-mails that directly promote the use of our website, products or services. When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to "opt-out" by following the unsubscribe instructions provided in the e-mail you receive or by contacting us at
    As described above, we may disclose your personal information to Developers for their own marketing purposes; however, we will cease any further disclosure of your personal information to Developers for their own direct marketing purposes if you "opt-out" by contacting us at If you wish to discontinue receipt of these e-mails, please contact the applicable Developer directly to update your preferences. Despite your indicated e-mail preferences, we may send you service related communication, including notices of any updates to our Terms of Use or Privacy Policy.
  2. Changes and Deletion of Your Data
    You may change any of your personal information in your account by editing your profile within your account. You can contact Iddiction at any time at if you would like Iddiction to delete your record and any associated data, other than data about you that is anonymous. We also need to retain one of the following: your Iddiction App unique identifer, your email address, or your Iddiction user ID. Please note that we may be required to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives.
  3. Opting Out of Third Party Tracking
    You may "opt out" of the collection of your information for third party analytics purposes by following the directions provided by our third party analytics vendor located at
    If you "opt out" with our third party analytics provider, that action is specific to the information we collect specifically for that provider, and does not limit our ability to collect information from you, under the terms of this privacy policy, for other vendors.

8. Information Protection

We use reasonable efforts to protect your personal information against unauthorized access and unauthorized alteration, disclosure or destruction. However, we cannot guarantee that your personal information will be absolutely protected. For example, your personal information may be affected by actions outside of our control, such as computer "hacking" and physical theft. You acknowledge that you provide your personal information at your own risk.

9. Our Privacy Policy About Children

We do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not attempt to register or send any information about yourself to us, including your name, address, telephone number, or email address. No one under the age of 13 may provide any personal information. In the event that we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. 10. International Transfer

We may transfer information that we collect about you, including personal information, to affiliated entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to the transfer of information to the U.S. and other countries, and the use and disclosure of information about you, including personal information, as described in this Privacy Policy.

11. Changes to the Privacy Policy

This Privacy Policy is subject to occasional revision, and if we make any material changes in the way we use your personal information, we will notify you by sending you an e-mail to the last e-mail address you provided to us and/or by prominently posting notice of the changes on our website. Any changes to this Privacy Policy will be effective upon the earlier of thirty (30) calendar days following our dispatch of an e-mail notice to you or thirty (30) calendar days following our posting of notice of the changes on our website. These changes will be effective immediately for new users. Please note that at all times you are responsible for updating your personal information to provide us with your most current e-mail address. In the event that the last e-mail address that you have provided us is not valid, or for any reason is not capable of delivering to you the notice described above, our dispatch of the e-mail containing such notice will nonetheless constitute effective notice of the changes described in the notice. In any event, changes to this Privacy Policy may affect our use of personal information that you provided us prior to our notification to you of the changes. If you do not wish to permit changes in our use of your personal information, you must notify us prior to the effective date of the changes that you wish to deactivate your account with us, and cease using our website, products, or service, or any Apps. Continued use of our website, products, or service, or any Apps, following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.

12. Your California Privacy Rights

Under California's "Shine the Light" law, California residents who provide personal information in obtaining products or services for personal, family or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year (e.g. requests made in 2012 will receive information regarding 2010 sharing activities).
